TERMS OF SALE


General Provisions


These general terms and conditions of sale (hereinafter also "GTC") govern the use of this website [[donsonalart]] and the purchase of items therein by any natural person who qualifies as a consumer (hereinafter the "Customer").


The Customer acknowledges that:


- the name [[donsonalart]] is owned by [[donsonalart]] with registered office at [[Via Carlo Feltrinelli 16, Milan]];

- the website [[www.donsonal.art]] is owned by [[donsonalart]] with registered office at [[Via Carlo Feltrinelli 16, Milan]];

- The seller of the Products, who is the contractual party with the Customer under these General Conditions of Sale (GTC), is [[donsonalart]]. with registered office at [[Via Carlo Feltrinelli 16, Milan]];

- Orders may only be placed by adults who are not legally incapacitated;

- The language in which the Contract is concluded is Italian. In the event of a conflict between versions of the General Conditions prepared in a language other than Italian and accepted by the Customer, the meaning and interpretation of the General Conditions in Italian shall prevail.


ARTICLE 1 - Object and Conclusion of the Contract


With these General Conditions of Sale, [[donsonalart]] sells to the Customer, who makes a distance purchase, the Products offered for sale on the website [[www.donsonal.art]] (the “Site”).

 

The contract is concluded exclusively online, through the Customer's access to the website [[www.donsonal.art]], by submitting a purchase order according to the procedure provided by the website and its acceptance by [donsonalart]]. The purchase order submitted by the Customer via the Website constitutes a contractual offer and is governed by these General Terms and Conditions of Sale, which the Customer must accept in full and without reservation. To this end, the Customer undertakes to review these General Terms and Conditions and the pre-contractual information provided on the page before completing the order.


The sales contract is concluded when [[donsonalart]] sends the Customer an order confirmation email. The email contains the Customer's information, the order number, the price of the purchased goods, shipping costs (if applicable), and the delivery address to which the goods will be sent.


The Customer undertakes to verify the accuracy of the personal data contained therein and to promptly notify [[donsonalart]] of any corrections.


In the order confirmation email, the Customer will also receive a link to download and archive a copy of these general terms and conditions of sale, as required by Article 51, paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.


ARTICLE 2 - Pre-contractual information for the consumer - Article 49 of Legislative Decree 206/2005


Before finalizing the purchase contract, the Customer must review the characteristics of the goods, which are illustrated in the individual product pages at the time of selection. Before finalizing the purchase contract and before placing the order, the Customer is informed of:


Identification of the seller;

Total price of the goods, including taxes, with a breakdown of shipping costs and any other costs;
Payment methods;
The deadline by which [[donsonalart]] undertakes to deliver the goods;
The conditions, terms, and procedures for exercising the right of withdrawal (Article 6 of these Terms and Conditions), as well as the standard withdrawal form pursuant to Annex I, Part B of Legislative Decree 21/2014;
Existence of the legal guarantee of conformity for the purchased goods;
After-sales service conditions and commercial guarantees.


ARTICLE 3 - Product Availability


Product availability indicated on the Site refers to actual availability at the time the Customer places the order. However, this availability should be considered indicative because, due to the simultaneous presence of multiple users on the Site, the Products may be sold to other Customers before the order is confirmed.


If the products ordered are unavailable for reasons beyond the control of [[dosonalart]], the order will be automatically adjusted by eliminating the unavailable product.

 

ARTICLE 4 - Prices

 

All product prices listed on the Site are expressed in local currency and include all taxes payable by the customer.

 

Shipping is free for all orders, whether delivered within Italy or outside Italy.

 

ARTICLE 5 - Payment Methods

 

[[donsonalart]] accepts various payment methods, including credit card, debit card, PayPal, and bank transfer.


If paying by credit or debit card, the order amount will be charged only when the order is complete and ready for shipment.

 

Communications regarding the payment and the data provided by the Customer when making the payment are transmitted over secure lines. The security of credit card payments is guaranteed by SSL/TLS (Transport Layer Security) encrypted data transmission protocol.

 

For each order placed on the Site, upon payment, [[donsonalart]] will issue a receipt for the shipped goods. This document will be sent to the Customer via email.

 

ARTICLE 6 - Right of Withdrawal

 

In accordance with current legislation, the Customer has the right to withdraw from the purchase without penalty and without specifying the reason, within 14 days of receiving the products.


Customers wishing to exercise their right of withdrawal must communicate this by explicitly completing the Return Form, which can be downloaded here. This form is drawn up in accordance with Annex I, Part B of Legislative Decree 21/2014.


If exercising their right of withdrawal, the Customer is required to return the goods within 14 days of notifying the seller of their intention to withdraw from the contract, pursuant to Article 57 of Legislative Decree 206/2005.


The goods must be returned to [[dosonalart]], returned intact, in their original packaging, complete in all its parts (including packaging material, documentation, and accessories), and complete with the accompanying tax documentation. [[donsonalart]] will arrange for the return shipment to be handled by [[donsonalart]], who will arrange for the goods to be picked up at the customer's home.


Once the integrity of the returned item has been verified, [[donsonalart]] will refund the amount of the returned products within a maximum of 14 days.


The Customer is responsible for any diminished value of the goods resulting from handling other than what is strictly necessary to establish the nature and characteristics of the goods. Therefore, if the returned Products are damaged, the Customer will be liable for the diminished value of the goods and will be entitled to a refund equal to the residual value of the Product.

 

As provided for by art. 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, [[donsonalart]] may withhold the refund until the goods are received or the Customer has demonstrated that the goods have been returned to the seller.


[[donsonalart]] will process the refund using the same payment method chosen by the Customer at the time of purchase.

 

ARTICLE 7 – Damaged Works


If the products you receive are defective, please contact [[donsonalart]] as soon as possible, attaching photographs showing the damaged parts. Please carefully inspect the package for any damage upon delivery, and the recipient is asked to sign the shipping document with the words "with reservation," specifying the details and extent of the damage found on the packaging.


If the work is damaged, you can send it back. [[donsonalart]] will examine it and, where possible, its professional restorers will restore it appropriately, at no additional cost to the Customer.


Please note that if more than one week has passed since receipt of the work, claims regarding damaged products will not be accepted.

 

ARTICLE 8 - Legal Guarantee of Conformity


Pursuant to and in accordance with European Directive 44/99/EC and Italian Legislative Decree No. 206/2005 (Consumer Code), the Seller guarantees the Consumer that the Products will be free from design and material defects and conform to the descriptions published on the Website for a period of 2 (two) years from the date of delivery of the Products to the Customer.

 

ARTICLE 9 - Liability


[[donsonalart]] assumes no liability for disruptions attributable to force majeure or unforeseeable circumstances, including those resulting from internet malfunctions and disruptions, in the event that it is unable to fulfill the order within the timeframes set forth in these GTC.

 

Whether exercising the right of withdrawal or the right to a guarantee of conformity, if the goods cannot be accepted by the seller because they do not meet the requirements for exercising the rights set forth in Articles 6 and 7 above, it is the Customer's responsibility to recover the returned goods at their own expense. The Customer acknowledges and unconditionally accepts that [[donsonalart]], 30 days after notification of the goods being made available to the Customer, may proceed with the legal disposal of the goods not collected by the Customer.


ARTICLE 10 – Final Clauses


The Products are sold with the characteristics described on the Site and in accordance with the GTC published on the Site at the time the Customer places the order, excluding any other conditions or terms.

 

[donsonalart]] reserves the right to modify these General Terms and Conditions of Sale at any time, at its sole discretion, without prior notice to users of the Site. Any changes made will be effective from the date of publication on the Site and will apply only to sales concluded on or after that date.


Prices, Products for sale on the Site, and their characteristics are subject to change without notice. Before submitting a purchase order, the Consumer is advised to check the final sale price.

 

These General Terms and Conditions of Sale constitute the entirety of the clauses that comprise them. If one or more provisions of these General Terms and Conditions of Sale are held invalid or declared as such pursuant to law, regulation, or following a decision by a court of competent jurisdiction, the other provisions will remain in full force and effect.

 

ARTICLE 11 - Applicable Law and Jurisdiction

 

These General Terms and Conditions of Sale are governed by Italian law. In any case, any rights granted to consumers by mandatory provisions of law in force in their country shall be unaffected.


Any dispute that cannot be resolved amicably will be subject to the non-exclusive jurisdiction of the Court of Milan. Furthermore, as a consumer, the Customer also has the right to bring proceedings before the courts of the European Union Member State of residence or domicile.
